These Terms of Service ("Terms") are an agreement between you and Future Focus Media ("we" or "us") governing your use of its websites, including pmvhaven.com (collectively, the "Website"). By accessing or using the Website you accept these Terms in full, whether or not you click to accept them, and you consent to receiving and storing records related to them electronically. Your use of the Website is also subject to the policies we post, including the Community Rules, the DMCA Policy, and the Privacy Policy, which are incorporated into these Terms by reference. If you do not agree, stop using the Website. If any part is unclear to you, consider consulting an attorney before continuing.

Changes to these Terms

We may modify these Terms at any time at our sole discretion. Changes take effect immediately upon posting and supersede all previous versions; the "last updated" date at the bottom of this page changes when we do. Continuing to use the Website after a change means you accept it. It is your responsibility to review the latest version periodically.

2. Age and eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Website. By using it you confirm and represent that:

• You are of legal age to view adult-oriented sexually explicit material.
• You have the legal competence to agree to and comply with these Terms.

5. Prohibited content and activities

You agree to use the Website only for lawful purposes. The following content is strictly prohibited and leads to immediate account termination and, where applicable, referral to law enforcement:

• Minors. Anyone under 18, or anything that sexualizes minors, including drawn or animated content (loli, shota). Violations are reported to NCMEC and law enforcement.
• Non-consensual content. Real rape or sexual assault, revenge porn, non-consensual deepfakes, and stolen private content.
• Extreme content. Snuff, gore, death, torture, real violence, real bestiality, real necrophilia, and real incest.
• Banned studios. Content from studios with criminal convictions or documented consent violations; the current list is on the Community Rules page.
• Privacy violations. Doxxing, identity theft, impersonation, and unauthorized private content.
• Hate and harassment. Racial slurs, hate speech, threats, and discriminatory content.
• Infringing material. Unedited copyrighted material posted without permission.

You also agree not to:

• Upload viruses, Trojan horses, worms, or other harmful software.
• Use robots, spiders, scrapers, or other automated means to access the Website without our written permission.
• Attempt to gain unauthorized access to any part of the Website, or interfere with or disrupt it, its servers, or its networks.
• Collect or store personal data about other users without authorization.
• Use the Website for any commercial purpose without our explicit approval.
• Create multiple accounts or use additional accounts to evade bans.

6. User conduct

When using the Website you agree to:

• Use it only for lawful purposes and respect the intellectual property rights of others.
• Be civil in comments and messages: no harassment, bullying, hate speech, or spam, and no sharing anyone's personal information without consent.
• Report violations instead of retaliating.
• Maintain one account per person. Usernames must not impersonate others or contain offensive content, and accounts and invites may not be bought, sold, traded, or shared. Keep your email address current for important notifications.
• Ensure every performer in content you submit is at least 18.

Depending on severity, violations result in:

• Minor violations: warning and content removal.
• Repeated violations: temporary suspension, 3 to 30 days.
• Serious violations: permanent account termination.
• Illegal activity: immediate ban and referral to law enforcement.

We have no obligation to warn before taking enforcement action. Severe violations result in immediate permanent bans.

7. Content submission

The Website offers interactive services such as comments, messages, and profiles through which users can post content. Anything you submit is not treated as confidential. You are solely responsible for any content you post, upload, publish, transmit, or make available on the Website, including its legality, reliability, accuracy, and appropriateness, and you assume all consequences of posting it. We may review user content but are not obligated to, and we are not liable to any third party for it.

By submitting content you affirm, represent, and warrant that:

• You own the content or have obtained the licenses, rights, consents, and permissions needed to publish it.
• You have the rights needed to grant the licenses described in section 8.
• The content does not include third-party copyrighted or proprietary material unless you have the owner's permission.
• Every performer depicted in sexual content is at least 18 years old.

If you send us ideas, suggestions, documents, or proposals, we are not obliged to keep them confidential and may use, exploit, or disclose them at our sole discretion without any obligation to compensate you.

We may reject, remove, or modify any content at our sole discretion, without notice or explanation, including content that violates these Terms, infringes rights, or could create liability for us.

8. Content licensing

License you grant us

You keep ownership of your content. By submitting it, you grant the Website a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, communicate, and perform it for any purpose related to the Website's business, including promoting and redistributing the Website through any media channels or formats. This includes displaying your content on any of the Future Focus Media sites that make up the Website. You waive any moral rights in the content, and we are not liable for any exploitation of content you post.

License you grant other users

You grant each user of the Website a non-exclusive, royalty-free license to access, use, reproduce, distribute, display, communicate, and perform your content as permitted by the Website's functionality and these Terms.

Termination of licenses

If you delete your video content from the Website, the licenses you granted us for it end within a commercially reasonable time, though we may retain server copies. Licenses granted for user comments are perpetual and irrevocable.

9. Intellectual property

PMVHaven, its logos, and its names are proprietary trademarks or service marks. Other trademarks, names, or logos appearing on the Website belong to their respective owners; no rights or licenses to any of them are granted to you, and their appearance does not imply endorsement in either direction. We cannot mediate trademark disputes between users and trademark owners: owners should resolve disputes directly with the user in question, and may contact us at contact@pmvhaven.com if that fails.

License to view the Website

The Website and the materials we authored, created, purchased, or licensed ("our Works") are protected by copyright and other laws, and we retain all rights in them. We grant you a conditional, royalty-free, limited, revocable, non-sublicensable, and non-exclusive license to access the Website and our Works solely for personal use. This license requires displaying the Website whole and intact as served, including its advertising; interfering with or blocking ads exceeds the license.

Where downloading is permitted, you are not buying a copy. You receive a limited, revocable, non-sublicensable, non-exclusive right to keep and use the copy for personal, non-commercial use only. You may not reproduce, distribute, publicly display or perform, adapt, share, or commercially exploit downloaded content. When this license or these Terms end, you must delete all copies in your possession.

Copyright infringement

Do not upload or share content that infringes anyone's copyright, trademark, trade secret, privacy, publicity, or other proprietary rights. Claims are handled under our DMCA Policy. We terminate the accounts of repeat infringers.

10. Data and privacy

This section summarizes how we handle your data. The full Privacy Policy explains it in detail, including your rights under EU data protection law, and controls if the two differ.

What we collect

• Account: username, email address, encrypted password, creation date.
• Profile: optional bio, avatar, banner, and social links.
• Content and activity: uploads, comments, ratings, favorites, watch history and playback progress, XP progress, subscriptions, and votes.
• Preferences: content filters, blacklisted tags, performers, and music, UI and notification settings.
• Personalization (opt-in): video completion rates by tag, performer, uploader, and music artist.
• Technical: IP address, browser type, device information.

How we use it

To provide and maintain the Website's features, remember your settings, filter content you have blacklisted, enable communication between users, personalize your experience if you opt in, improve recommendations, and maintain security and prevent abuse.

When we disclose it

We do not reveal personally identifiable information except as described in these Terms or the Privacy Policy, with your consent, when required by valid legal process or governmental request, to protect the Website's property, operations, or safety, to an entity that acquires the Website, or as otherwise required by law.

Your controls

You can opt in or out of personalization, clear or disable watch history, control what your profile shows publicly, and set up content blacklists, all from your settings. To request account deletion, contact contact@pmvhaven.com.

Third-party advertisers deliver ads directly to your browser and may collect your IP address or use cookies and web beacons. We do not control how advertisers collect information; on their own, these identify devices rather than individuals.

11. Enforcement and moderation

We reserve the right to:

• Reject or remove any content at our sole discretion, without reason or explanation.
• Act on any content that violates these Terms, infringes rights, threatens safety, or could create liability for us.
• Disclose your information to third parties who claim your content violates their rights.
• Take legal action for illegal or unauthorized use of the Website.
• Terminate or suspend your access for any reason, including violations of these Terms.
• Cooperate fully with law enforcement and court orders, including disclosing the identity of anyone posting content.

We may review, monitor, reject, or remove content at our discretion, but we do not review content before it is posted and cannot guarantee prompt removal of objectionable content afterward. We assume no liability for any action or inaction regarding user content.

If you breach these Terms or create legal exposure for us, we may terminate your access immediately. On termination you lose access to your account and uploads; we are not obligated to help transfer your data or to keep backups, so keep your own copies of your content.

12. Liability and indemnification

You use the Website at your own risk. It is provided "as is" and "as available." We disclaim all warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for, among other things: removing or delaying content; modifying or discontinuing the Website; terminating your access; errors, omissions, or unavailability of information; lost or deleted user content; personal injury or property damage; unauthorized access to our servers or the information on them; interrupted transmissions; bugs, viruses, or malicious software introduced by third parties; or loss arising from your interactions with advertisers or other third parties.

Under no circumstances are we liable for any incidental, indirect, punitive, statutory, exemplary, expectation, special, or consequential damages whatsoever, including lost profits, lost goodwill, interruption, or loss of business information, in connection with any claim arising out of these Terms, even if we have been notified such damages are possible.

Indemnification

You agree to defend, indemnify, and hold harmless the Website, its parent corporation, site operator, affiliates, and all associated parties from any claims, damages, losses, liabilities, costs, or expenses (including attorney's fees) arising from your use of the Website, your breach of these Terms, your violation of any third party's rights, or any allegation that your content caused damage. This obligation survives the end of these Terms and your use of the Website.

13. Governing law

The laws of Denmark govern these Terms, your use of the Website, and the relationship between you and us, without regard to conflict of law rules. The Website is based solely in Denmark and is a passive website that does not give rise to personal jurisdiction over us elsewhere. The exclusive jurisdiction and venue for any action arising out of these Terms is an appropriate court in Copenhagen, Denmark, and by using the Website you consent to the jurisdiction and venue of those courts. Any claim you have arising from these Terms is compensable by monetary damages only, and you waive any right to injunctive or other equitable relief.

Any legal claim related to these Terms or the Website must be initiated within one year from when the cause of action occurred, or it is permanently barred, despite any statute or law to the contrary.

14. General provisions

• Severability. If any provision of these Terms is held invalid or unenforceable, it is enforced to the maximum extent permissible and the remaining provisions stay in full force.
• Entire agreement. These Terms, together with the policies they incorporate, are the entire agreement between you and us regarding the Website and supersede any prior agreements on the subject.
• No waiver. If we do not enforce a provision, that is not a waiver of it or of our right to enforce it later.
• Assignment. We may assign these Terms, for example in connection with a sale of the Website. You may not assign them or your account to anyone.
• Termination of these Terms. We may terminate these Terms at any time by giving notice through the Website, by email, or by other communication. Termination does not waive any of our rights, remedies, claims, or defenses.
